About

It is often said that upon the arrest of an accused person, a defense lawyer is the accused’s very last friend. This is because a defense lawyer is the very last person whom the accused can speak with that will be on the side of the accused. Once that communication is over, the accused person is entirely in the hands of the party adverse to his/her interests. The adverse party is keen only on making their side of the case stronger. An accused may feel cooperating with the police may help his/her case. When the legally inexperienced accused is sitting across the adverse party who is far better equipped, experienced and exercises a great deal of both physical and psychological control, there are many things that could backfire. It is therefore the duty of the defense counsel to provide the accused with the very best time-sensitive advice.

Charter s.10.Everyone has the right on arrest or detention:
